How Do I File for Divorce if My Spouse is Missing?

Moving Forward with Divorce if Your Spouse is MIA

While many couples file for divorce as soon as they decide the marriage will no longer work, others choose to separate indefinitely or simply abandon the marriage. This can sometimes result in a “missing spouse”, meaning that the husband or wife has no idea how to locate their other half to serve them with divorce papers.  Courts require some sort of service or legal notification to the non-filing spouse that a divorce action has been filed, giving that person an opportunity to be heard in court.

In this instance, notice to your spouse can often be satisfied through “Service By Publication”. To get the court to accept this form of service, you’ll have to prove that you have made a diligent effort to locate your spouse and by “diligent”, we mean more than just a few phone calls.

Once you’ve exhausted all of your efforts and received approval of the court, you can publish an ad in a local newspaper notifying your missing spouse of the divorce proceedings in process. Notice that the ad is run after the divorce is filed and the choice of which newspaper is typically left up to you, although you may want to verify this with the court clerk as there may be a recommended paper typically used by the court or a requirement as to the size of the paper’s circulation for such matters.

Assuming your missing spouse does not respond within a given timeframe, your divorce would then be granted as a default judgment.  The court would grant you a divorce and decide all of the terms of the divorce in the manner which you have requested.

Depending upon your circumstances, a “missing spouse divorce” can often be obtained without hiring an attorney by using a do-it-yourself divorce form.

    My friend wants to divorce her husband who she married about 8 years ago in Cuba. She has not seen her husband since and she believes he is presently in Mexico somewhere. My friend is a Florida resident. Can she get divorced using the missing spouse papers? Where would she file the ad — in a Florida paper? Thank you.

      Your friend should file a petition for dissolution in Florida where she lives. Your friend should consult the family law rules in the county she lives in for the procedures for a default judgment.

    I know someone that wants a divorce from his wife. They were married in Kentucky and have been seperated for nearly 6 yrs. And he doesn’t know were she is and she has their kids. How would he go about getting a divorce spproved through the courts. He now lives in Tennessee and has lived there for some time.

    My spouse has been abusive to both me and our son. I got a pretective order protecting myself and son against him, but I have no clue where to find him to file for divorce and I dont want to either I am sort of afraid of what he might do. He is an alcoholic/drugy. He took my son on drug deals without my knowledge when I was at work, with my stolen rent money. He is wanted in the state of Maryland for assualt in the 2nd degree for attacking me. He has left bruises on my son as well. I have been abused by him over and over. I want to get my life back with out him. I dont want his hands on my son again, plus want his rights taken away. I want full custody and i dont want him to know where we are located, so I know we are safe. How do I file and how do I get what I want? Is there programs help me pay for the devorce as well? I want to get it over with quickly too. Thank you!

      I think the first thing to worry about is not a divorce but getting somewhere safe especially for your son.Do you realize how much it is affecting him currently mentally,emoitionally and physically? You are all he has and he doesn’t need to bury his mom because she is to scrared to leave. There are battered womens shelters in every city you need to get there your husband is a big pussy and needs to get his ass beat by a man so he can stop hitting a woman! I have performed atleast 30 autopsies this year on battered women who can’t get out..if you are that scared call the police or ask your neighbor to come to your house to keep you safe while you can gather the most important things you have and to get out of there, alot of these shelters will help you get a job,to become self sufficient and independent ,they help with rent,furniture and utilities you need to call catholic churches in your area I will promise you they will help you …when all else fails put your hands in gods and he will walk you in the correct path, if you do the right thing you will be blessed because you chose the best choice for you and your son, I will pray for you and your boy,but please leave and don’t ever go back,he will not change,he does not love you so why are you there still?

    I live in oklahoma. I have been seperated from my husband since 1998. I have tried to find him several time. There are no children from this marriage. How will I show the courts my efforts to contact him?

      Each individual state has the power to decide the marital status of its residents. If you meet the residence requirements of the state in which you reside, you should be able to file for divorce. You should also follow the state’s due diligence requirements in order to “serve” a spouse whose whereabouts are unknown. The article above refers to such a procedure. Good luck.

    What if the wife is in Mexico and was in US illegal only for papers and then moved back to Mexico before papers for visa were expedited. Now she wants a divorce but can’t get back to U.S. and can not find the spouse for a divorce decree. Can the wife go through divorce publication in Mexico to finalize ????

    My spouse and i have been a part from each other since Oct 2009. After i moved out of our home so did he. He has left me no way of finding him. When i contact his family as to about his whereabouts I get no answer. I would like to file for a divorce and be done with it. But I do not know the proper steps to get me there. We have no children together and I still live in Maryland. But have no idea if he is still in this state or not. I just don’t know what to do.

    my friend wants to get a divorce she has been separated for over 10 years …he was in jail for about 8 for dealing drugs, he was abusive though the whole marriage about 2 years ago he got deported to mexico. she hasnt heard from him since he got deported and has no idea where he might be. they have 2 children together and now she wants to get a divorce. she married him in the states but she recently moved to mexico with her current partner.my question is can she still file for a divorce in mexico even tho they married in the states??

    I have been mutually separated from my spouse for about 3 years. I have been in a relationship with someone else for the past 3 years and have had 2 children. She has also had a child during this time and has been in several different relationships. I have also heard that there is a possibility that she has even remarried. However no divorce papers were ever filed and no divorce decree has ever been issued. I am looking to try to disovle this marriage ass soon as possible so that I can marry the girl i have been with for the past 3 years. I do not have enough money to hire a divorce attorney. I also do not know where this spouse lives. How can i go about getting my divorce under these circumstances?

    i just dont get it you want a divorce, but cant find your husband and his family tells you to just file . but they dont know where he is .i just want to get this over with,i dont got any money to do a search for him or any of that i just want to know if i mail him papers to his mom and brothers house can either one of them sign for them if hes not there and how long do i gotta wait to hear back. total confussed and total want this over with its been 8 years so please some one help me figure this out. thanks

    my wife is missing i dont know where she is i came home and she was gone. she has been living here in usa from phillippines since nov 2007 what do i have do file with immgration or police? does that mean her green card be revoked i dont know what do please help

      You can see what the requirements are in your state. I married a woman formt he Philippines and she left me. She has very limitied contact to say that she is home in her province. No real evidence of this. So I will be filing a divorce without her, filling out paper work at the divorce clerks office for Service by Publication where an add it run in a local newspaper and fulfill your requirement to notify her. Hopefully after doing this, the judge will order a default divorce for her not coming forward. I live in Indiana so it should only take 60 days once filed. No children involved and no property to split. As far as immigrations, you cannot revoke her conditional green card. She can apply for her permanent one without you with a waiver, but she has to prove that she entered the marriage without fraud to get the green card. You can write a detailed statement and send it into immigrations before she file for the 10 year card. Reference her Alien ID # from immigrations. If she does not file the waiver within 90 days and her card expires, then it is revoked. If she leaves the U.S. for more than one year without rentering, then it should be revoked. THe real kicker is that yu are still responsible for her if they give her a 10 year green card and have to pay back bills she accrues if she becomes a public charge to the people of the U.S.. Divorce does not relieve you of this responsibility, but it is stated on the Affadavit of Support. Good luck. I feel your pain. I am going through it right now.

    I have been seperated from my husband for almost 4 yrs. We have a a 4 yr old together. I have not seen or heard from him since he left. We were FL residents when we were married. I have since moved to GA and now I am a GA resident. As far as I know he is still in FL. I have tried to reach him every way possible. He never responds. I do not know how to get divorced. I have telked to the court in FL. They say I am not a FL resident anymore they cannot do anything for me. Here in GA they do not know what to do about he is in FL and I am in GA. Please help me. I would like to move on with my life.

    I have a MIA spouse, but not only that I have a daughter we thought might have been his, but it was my former boyfriend who I broke up with the week before we married. Jerks name is on the birth certificate, but he is not the father. Do I have to do a paternity test to prove this in order to keep him from getting visitation? I don’t want child support since I know he’s not the father. He’s known to “pop up out of nowhere” but he left me and my daughter at the hospital when she was only a week old 5 years ago, and we have been separated ever since. We’ve been married 6 years now. I want the nightmare to end!

    My husband walked out over eight years ago and I have tried everything to find him. I am on disability and have been wanting to get a divorce but do not know how to do it, or how to find out if he filed, or whether I can afford to even file. Please tell me how i can do it my self as low cost as is possible,and how to find out if he has filed, for free if at all possible.     My wife and I got married in Iowa 5 years ago. She left me back in September of 2010. All I know is that she now lives in North Carolina.       File for divorce in your state, Ask for the service by publicaion forms from divorce clerk where you file the divorce at and put an ad in a newspaper in the city where you she lived and you have an address for.This should be sufficient for you to get the divorce by default. Most states allow this as an official attempt to notify your spouse that divorce action has been taken and if she wishes to contest it, she needs to notify the court where you filed it. Google for free divorce forms in the state you live and will file. I hope it helps you. Good luck,

    I have been seperated from my ex for about 6 yrs. We were only married for 3 months before he abused our son and I put him in jail for child abuse.We got married in Texas. He is currently in a half way house in texas. But we are court ordered not to speak to one another. I would like to file for a divorce but I just moved to South Dakota about 1 month ago. Do i file in south dakota or can I still file in Texas?

    I married a my wife in feb 2009. I had to go on a deployment in DEC 2009. I got back in june 2010. I was able to get hold of her to get a divorce but she stop answering my calls and never told me where she stayed at. I tried calling and it got to the point that couldnt reach her at all.     I’am out of the country and my wife is trying to divorce me. We have seperation papers already served. I don’t want the divorce.I haven’t been served with divorce papers yet because i live in the jungle with no address. Can she still divorce me without serving me papers,if so how can i combat this?

    My soon to be x husband is a registered sex offender and left me me on may 11, 2011. Told me a big lie said he was going to work with fema. Well a month went by and I didn’t hear from him. I got a call on June 24, 2011 from a cop in Franklin Co. TN stating my husband had been arrested for not registering with that county. He was also living with another woman and her two kiss and married her on June 20, 2011 in north Carolina. I’m trying to get my divorce from him he got out of jail in October and I sent him packing to his grannies. I’ve been to the court house with my divorce papers cause I can’t afford an attorney. I have no way to contact him and his family wont tell me where he is. I have heard rumors he left the state and their are three warrants fir his arrest. The courthouse here in Bedford county told me its gonna cost 245.00 for me to run an ad giving him a chance to sign the papers since I don’t know where he is. I’m a single mother on a fixed income please tell me how to pay for that ad. It stressing me out more and more everyday how to come up with the money. I can’t get a loan cause he has put Mr in a lot of debt. Please help me.

    I was married to my husband in ohio soon after we went to mexico…came back to the states 13 yrs. Later been here 7 yrs I want a divorce he currently is in mexico and now unable to come to the states …I know where he is and I am able to contact him if needed. How can I serve him divorce papers to him trying to do this divorce my self thru the courts because unable to pay a lawyer….we have one minor child ..no property or debt and do not want nothing from him jus a divorce…can anyone give me light on this issue?

    me and my husband have been married sence 2007 and seperated sence 2009, he is now contacting my family with threatning messages as of 4-25-12, he told me back about in 2010 to get the divorce myself sence i wanted it, he has no job and i dont know his address and he was abusive to me, i am a low income singel parent of 2 children and i was scared of divorcing because i have vary low income and i did go and buy the do it yourself kid but mose of it foesnt apply to me because we have nothing together except children and i want nothing to or from him but for him to leave me and my family alone. is there a way for me to get a free divorce or should i just get legally seperated? what should i do?

    Divorce to a missing person=
    I personally went through this type of divorce with someone I personally know. I forgot what it is called. But the lawyer or company that will work your case will put a legal ad in the paper, and your “missing spouse” has like 30 days to respond, if they do not you will receive a court hearing and you will be granted a divorce. we went through a company called http://www.thedivorcestore.com and it was about $800 total I dont recall having to give all of that up front.

    My son married a woman from Columbia and the 2 worked to getting her green card. Upon finding out she was approved to get her green card, my son came home from work and found out she took furniture and disappeared. How does he go about getting a divorce from this woman and does he let the Immigration people know what she has done.     I got a shotgun wedding in 2010, to keep a man I had fallen for in the states. Weeks later he was abusive, and 6 months later, I had it with him. We both agreed on a divorce, but after trying to contact him for the last year, even his mother, there was no luck. He’s back in Sweden. He never got his green card, and I’ve heard so little from him that I believe that he’s dead. I’ve been with a great guy since late 2011 and someday I want to marry him.     I met my wife in may 2004 through her sister, I was in the process of getting a divorce, which was finalize in 7/10/2004. The woman whom im married to, wanted me to married her, because she was here on a temp visa for a relatives funeral, and was expiring in jan 2005. I did married her since i was broken hearted from just learning of my divorce and was diagnosed with cancer of the liver. I told the now my wife and she claimed she didnt care about my illness. We ended up getting married sept 25 2004 and we didnt start living together until jan 2005 under the conditions that i would file for permanent resident for her. I did in Jan 2005 , She also ask me to send for her daughter in Dominican Republic, which i did and in a quick way because she was turning 20. for the following years I strugled with cancer and had to leave my job and go on disability as of July 2009 and in that dec 10, 2009 , I came home one day and she and daughter were gone, I have lost communication , dont know where she lives, someone gave me an address in kendall fl. I sent her divorce papers and she has never answer. I need to get on with my life and need a divorce. What should i do, dont know if to notify immigration as im hers and her daughters sponsor.

    I have been separated from my husband for almost a year now. We have sold our house and split the money and our belongings equally. I would like to get a divorce, as we both now have new partners but he is not answering my phone calls or text messages. Can anyone please advise me what to do next? Although my husband has a job I know that he will not pay anything towards the cost of a divorce. We do NOT have any children. If he won’t return my calls how can I file for divorce?

    friend married in 1983 in dallas tx got married to fix his green card, never lived with lady or anything, only have her first and last name and year 1944/1943 year born have looked all over the net using people search but can not located once person with his last name or a for such person.
    he wants a divorce but i am at ends of what to do. its been over 30 years since the marraige. he lives in wisconsin and we have no idea where she lives or even if she is alive.

    I have a question. I know where my spouse is but he is in mexico. How would I serve him the papers. We have been married 8 years and I haven’t seen him in 6. Can someone help me?

    I served my husband divorce papers almost a 1 1/2 ago. He has since dissappeared. The last communication was with his daughter a month or so ago. He won’t give me his address, and all I have is a cell number to reach him, but he won’t answer. My attorney says i can’t notify him through public notification because I have already filed a motion. I don’t understand this. Can any one tell me what I can do to get this resolved?

    I live in washington state and my spouse is unlocatable in georgia. I cant afford to try and find him or to put an ad in the paper. Any idea what I can do?????

    Major issue because of Missing spouse that we can’t go for legal mediation. As for mediation there is need of both person.

    I have not been with my spouse since 2002. Is there some way I can file a motion for a divorce since it is now 2013 without having to do the missing spouse process being it takes so long

    - I am kasha i lives in uk and i was in a serious relationship with my ex guy for three good years.. One day we were in a dinner party, we had a little misunderstanding which lead to a Quarrel and he stood up and left me at the dinner party. i try to call him but he was not picking my calls so after than i contacted my brother and told him about it,my brother so much love me that he had to see him on my behalf,he told my brother that it is over between us.. Then i contacted a friend of mine that had this similar experience and she directed me to one of the spiritual diviner (maduraitemple@yahoo.com).at first i thought it was not going to be possible and i contacted him i was ask to come up with a little requirement,so i did what i was ask to do, after 3 days i was in my office when my ex guy called me and was asking me to forgive him and come back to him. i was very surprise it was like a dream to me,so ever since we have been happily married with one kid my lovely baby(Ceslav)…i wish you the best of luck…

    I have been seperated from my husband for nearly seven years due to abuse, i know he lives in Iowa and I reside in PA Idont know where Iowa he lives nor have a phone number, i know he has a facebook but never responds to me… what do I do? my boyfriend of 3 years and i want to get married but this is holding our lives up. My husband and Ihave one child, but my father has custody of him and we shared no other property…. i need help

    I got married in nov 08 and seperated in june 09 my husband left my home and moved back to essex. Iv been trying to find out where he lives and no joy. I’m desperate to get a divorce and move forward with my life. I went to a solicitor and they were not very helpful as they said without an address I can’t do anything. My husband has been away from me for 4yrs this year. Can someone please help me and give me advice as to how I can now get a divorce without his whereabouts. I work 30hrs a week so couldn’t afford to pay leagle fees ?? Please someone help me

    Hi I’m trying to divorce my wife of 2 years, we have no children and she changed and blocked her number so I have no idea where she is or how to contact her. Even her own family doesn’t know where she is or her phone number. I have lost my job so my income is very limited and i cant afford the attorneys or filing fees, Can I still get a divorce?

    I married a Canadian in 2010 we met in 2009 she lived here illegally and no immigration papers were filed. She moved in with me in 2009 and prior to and after our marriage in the first year she would cross the border and come back and then stay her 6 months on her visitor’s visa. She never took my last name so they never knew she was married when she crossed back over her passport expired over 2 years ago. She left me in Dec 2012 without telling me and went back to Canada. She gives me an address of a business where she works no phone number and blocks all email. She has been gone 3 months and within a month of leaving has already committed adultery. I was told March 26 2013 of this by her and that she is in love with another man and they plan to have kids and blah blah blah. I then get a phone call from her boyfriend telling me she doesn’t want me. So I told him this is a marriage this is still my wife and you have both committed adultery and this is our Divorce/Separation and to stay completely out of it. I am now stuck in California with an extra vehicle and trailer. We sold our house in August and decided to be snowbirds and left Idaho in October. She also ended our business that was partnership. So I have no income now no way to get back to Idaho she tells me she had her passport renewed. I call immigration it seems to be perfectly fine to Come to the United States of America Illegally without the proper paper work get married leave the Country and able to cross the border anytime she wants. EIC says well she is in Canada what do you want us to do? Oh I guess nothing even Canada doesn’t know she was married. That’s our Government doing their best to protect our Country and Borders! WHAT I WANT TO KNOW is how do I file for divorce against an illegal immigrant and on the grounds of Adultery? I’m not going to be nice about this and I shouldn’t since I am stuck 1300 miles away from my residence and unable to get back there! So if you are going to respond then respond only to the questions I do not need an opinion on life and what’s right and what is wrong. Or say I am bitter or any other comment. I want to know since I can’t find any forms online and everything I Google it’s about divorcing someone that’s already deported, nothing on the grounds of Adultery yet in the state of Idaho it’s a Felony. So come back and give me the old Pilgrimage time etc. How do you file against an illegal immigrant divorce in the state of Idaho? I guess if she crossed the border now on a Visitors Visa and still being legally married she could be charged with Visa Fraud? But no Immigration doesn’t give a damn. So if you know any illegal aliens tell them it’s cool to screw us Americans over and they are free to roam about the country!

    I got married injuly 2011 and in december 2011 my little sister got pregnant by my husband of course he fled to mexico because she was only 14 at the time and ive been wanting to get divorced we dont have children together and i dont have money to pay for a lawyer what can i do i want to move on with my life but being married wont let me

    I need to get divorced & i cant find my husband he fled to mexico after getting my 14 year old sister pregnant this was in 2011 what can i do we didnt have children together all i want is a cheqp divorce & fast

    Me and my Husband were married in Sep. 5, 2009. After 8 months of marriage he was deported to Costa Rica. I have no ways of getting a hold of him. When we did talk he said they do not have addresses there. He has never been a citizen of the US he ran across the Mexico border. I don’t know how we were able to get married with out legal papers. Please help I have been searching since 2009!
