A-Rod Responds to Wife’s Divorce Petition 1

Alex-Cynthia RodriguezYankees superstar Alex Rodriguez has filed his formal response to wife Cynthia Rodriguez’s Petition for Dissolution of Marriage in a Miami court. No major bombshells were dropped in the filing but A-Rod did claim that any allegations of adultery again him were “immaterial and impertinent.” Many press reports linked the baseball player to pop star Madonna, who is also married.

Cynthia’s divorce petition, you may recall, contained several allegations of extramarital affairs involving her husband. A-Rod’s filing points out that Florida is a no-fault divorce state and claims that adultery allegations have no place in the dissolution litigation. While it is true that Florida is a no-fault state (meaning that the only grounds that one must prove are that the marriage is “irretrievably broken”), the alleged adulterous affairs could possibly be relevant to a judge when dividing the couple’s marital property. Florida laws allow the court, while deciding how to split the marital estate, to consider any factor which might be necessary to do justice for the parties.
In the Rodriguez case though, the judge may not have to do anything regarding property. They apparently signed a prenuptial agreement a month before their 2002 wedding. Cynthia has not explicitly asked the court to invalidate the agreement but has asked the court to review it to determine whether or not it is enforceable. Alex’s response seeks enforcement of the prenup – which presumably is to his financial advantage.

So far, the Rodriguezes have done a pretty good job of keeping to themselves and keeping the divorce (and their kids) relatively quiet. Her attorneys made some grandstanding-type statements at the time of the filing but have been silent since then. His lawyers have said next to nothing publicly. Neither party has made any statements to the press. This may be one celebrity divorce that actually goes away quietly. Or not. We’ll just have to wait and see.
