Tyrese in Divorce Battle after 10 Month Marriage 0

Model/actor/singer/rapper Tyrese Gibson was in a California court this week, fighting with his estranged wife Norma Mitchell over various aspects of their divorce case. Gibson and Mitchell were married in December 2007. Gibson filed for divorce in October 2008. Another one for our list of shortest celebrity marriages!

RadarOnline has published some recently filed legal documents in which Mitchell seeks attorneys’ fees as well as additional child support and spousal support. She also contests the validity of the couple’s prenuptial agreement and seeks primary physical custody of their one year old daughter Shayla.

TMZ now reports that a judge has ordered the former “Transformers” star to pay Mitchell a lump sum of $65,000 in addition to $6,230 a month in child support. Gibson will also pay Mitchell’s rent ($2,730/mo.) and car payment ($800/mo.). It appears to me that these are temporary support figures pending resolution of the divorce case.

(Also, TMZ seems to make a big deal over the fact that the judge apparently ruled that Gibson can “write off” the rent and car payments. I’m not sure what TMZ means by this but payments that are deemed alimony or spousal support are always deductible from the paying party’s taxes. The person receiving the alimony pays the income taxes on those funds.)

TMZ also reported that the validity of the former couple’s prenuptial agreement will remain undetermined until August 13 and 14 when Judge Nick Young makes his final decision. Two days on a family court’s schedule means a hearing or trial. So, unless they reach a settlement (which occurs in most divorces), there will be testimony related to the prenup later this year.

Mitchell claims Gibson made an estimated $800,000 during their marriage, that she had to sign the prenup due to her circumstances and that it would be “unreasonable” for her to walk away with nothing. Mitchell is not an American citizen, had only a temporary traveler’s visa and allegedly feared that she would have to leave the country without her daughter if she had refused to sign the prenup and marry Gibson.
